ENG3N Attorney Membership Agreement

Effective Date: April 28, 2026

1. Parties and Platform Role

​

This agreement is entered into between ENG3N LLC, a North Carolina limited liability company, and the subscribing attorney member. ENG3N operates as an online marketplace connecting licensed attorneys with independent industry professionals for purposes of litigation support, consulting, research, and expert witness services. ENG3N is not a law firm, employer, staffing agency, or legal services provider. ENG3N does not supervise, participate in, or bear responsibility for any engagement, agreement, compensation arrangement, or outcome between attorney members and professional members connected through the platform. All such arrangements are solely between the engaging parties.

2. Eligibility and Verification

​

Attorney membership requires a valid and active state bar number. Submission of a bar number constitutes consent to verification. Applications are reviewed at the sole discretion of ENG3N LLC. Approval is not guaranteed. ENG3N reserves the right to decline any application without explanation. Membership may be revoked at any time upon a finding of misrepresentation, violation of these terms, or conduct deemed detrimental to the platform or its members. Revocation of membership for any violation of these terms does not entitle the member to a refund of any kind.

3. Subscription Terms and Pricing

​

ENG3N attorney membership is one flat annual subscription. There are no tiers, no seat counts, and no internal access restrictions. ENG3N does not monitor, limit, or govern how account access is managed internally. That is solely the account holder's responsibility.

​

Annual subscription: $990.00 per year. Twelve unlock credits included at activation.

​

All subscriptions are billed annually through ENG3N's third party payment processor. Membership activates upon receipt of payment and expires 365 days from the activation date. Membership does not renew automatically. Renewal notifications are sent at 60, 30, and 5 days prior to expiration and again on the date of expiration. It is the sole responsibility of the member to renew prior to expiration. ENG3N is not responsible for missed renewals.

Each member account holder assumes full and sole responsibility for all activity conducted under their account regardless of who initiates that activity. ENG3N has no visibility into how account credentials are managed or shared and accepts no responsibility for credits spent by any individual accessing the account with or without the account holder's authorization. Credits consumed under any account are consumed. They are not recoverable, reversible, or subject to reinstatement on the basis of unauthorized use, misuse, or any other circumstance originating within the account holder's own account management. The account holder's obligation to ENG3N LLC is not diminished by any internal dispute, unauthorized access, or misuse of account credentials regardless of how that access was obtained.

4. Unlock Credits and Additional Credit Purchases

​

Each unlock credit entitles the attorney member to access the name and direct contact information of one industry professional listed on the ENG3N platform. Prior to the expenditure of an unlock credit, professional profiles are displayed anonymously. Credentials, expertise, availability status, and litigation side preference are visible. Identity and contact information are not.

​

Twelve unlock credits are issued in full at the time of membership activation. Credits do not accumulate over time and are not issued on a monthly basis. Unused credits at the time of membership expiration roll over into the next membership term only if the membership is renewed prior to expiration. Upon renewal the member receives a fresh twelve credits in addition to any rolled over credits from the prior term. Credits rolled over from a lapsed membership are forfeited permanently. A lapsed membership that is subsequently renewed starts fresh with twelve credits only. Rolled over credits carry no cash value and are subject to the same terms as originally issued credits.

Additional unlock credits may be purchased at any time during an active membership. Additional credits are made available to active members at a rate of $55.00 per credit,representing a 33% discount off the base per credit value of the annual subscription. This discount is a benefit of active membership and is not available to non-members. Additional credit purchases do not extend the membership term. All additional credit purchases are final and non-refundable.

Accessed contact information remains visible to the attorney member for thirty days from the date of the unlock. Following that thirty day window the contact information is no longer accessible through the platform. ENG3N is not responsible for contact information that was not retained by the attorney member within that window. No credit reinstatement will be issued for expired unlocks.

​

5. Payment and Refund Policy

​

All membership fees are collected in full at the time of activation through ENG3N's third party payment processor. By submitting payment the attorney member acknowledges that they have read, understood, and agreed to the terms of this agreement in their entirety.

​

All payments made to ENG3N LLC are final and non-refundable without exception. No refund will be issued for any reason including but not limited to non-use of the platform, failure to find a suitable professional, dissatisfaction with results, early cancellation, or termination of membership due to a violation of these terms. This policy applies equally to annual subscription fees and to additional unlock credit purchases.

​

The decision to subscribe is made solely by the attorney member. ENG3N does not solicit payment prior to approval and does not collect fees from applicants who are not approved. Once approval is granted and payment is submitted, the member has exercised their right to join and the transaction is complete.

​

6. Professional Profiles and Due Diligence

​

Professional credentials and experience listed on the ENG3N platform are self-reported by the professional member at the time of application. ENG3N verifies attorney bar numbers as a condition of attorney membership. Professional credentials are not independently verified by ENG3N beyond the documentation submitted at the time of application.

​

It is the sole responsibility of the attorney member to conduct independent due diligence on any professional prior to engagement. The expenditure of an unlock credit does not constitute a warranty, endorsement, or representation by ENG3N regarding the accuracy of any professional's self-reported credentials, experience, or qualifications. ENG3N makes no express or implied warranty regarding the fitness of any professional for any particular case, matter, or purpose.

​

Attorney members are advised to conduct all engagements with the same standard of professional care they would apply in any other context. The platform is a connection tool. What the attorney does with that connection is entirely their professional responsibility. 

​

7. First Contact Framework

​

Upon expenditure of an unlock credit the attorney member gains access to the professional member's name and direct contact information. ENG3N is not a party to any communication between members following an unlock and bears no responsibility for the content or outcome of those communications.

​

ENG3N recommends that initial contact consist of a general case overview only, containing sufficient information for both parties to determine whether a conflict of interest exists, but not containing client names, opposing party information, privileged case strategy, or confidential documents of any kind. This recommendation is offered as a best practice framework. ENG3N does not monitor, control, or govern communications between members.

​

Both the attorney member and the professional member are independently responsible for identifying and disclosing any conflict of interest prior to engagement. ENG3N assumes no responsibility for conflicts that are not identified or disclosed by the parties themselves.

​

Members are solely responsible for protecting privileged and confidential information in all correspondence conducted outside the ENG3N platform. Any disclosure of privileged, confidential, or sensitive case information prior to a signed engagement agreement is made solely at the disclosing party's own risk. ENG3N accepts no liability for the consequences of any such disclosure.

​

8. Confirmation of Agreement

​

As a condition of active membership, each attorney member is required to send a confirmation email to info@eng3nllc.com within 48 hours of payment confirmation. That email must contain the following statement and nothing else:

​

"I, [Full Legal Name], Bar Number [State Bar Number], have read, understand, and agree to the ENG3N Attorney Membership Agreement effective April 28, 2026."

​

Failure to submit this confirmation within the required time-frame does not void the membership or entitle the member to a refund. However, absence of this confirmation email on file with ENG3N LLC may be considered relevant in the event of any dispute filed by the member. Submission of this email constitutes an independent acknowledgment of agreement separate from and in addition to the checkbox confirmation completed at the time of application.

9. Credential Disputes and Credit Reinstatement 

​

ENG3N understands that an attorney member's time, reputation, and client relationships are not abstract concepts. They are the foundation of a legal practice. When something goes wrong on this platform we take that seriously. Every concern submitted to ENG3N is treated as legitimate until the evidence determines otherwise and every member who raises a concern will be heard.

​

If an attorney member believes that a professional member has materially misrepresented their credentials, experience, or qualifications, the attorney member may submit a formal dispute to info@eng3nllc.com 

 

A compliant dispute submission must include all of the following:

​

  1. Complainant's full legal name and state bar number.

  2. Date of membership activation.

  3. Date of the unlock in question.

  4. Name of the professional member being disputed if known.

  5. A clear and concise statement of the specific misrepresentation claimed. Facts only. No narrative.

  6. The specific credential or representation that was found to be false.

  7. Supporting documentation consisting of one or more of the following: licensing records, certification records, public records, correspondence, or any other verifiable evidence directly contradicting the professional's stated credentials.

  8. A signed statement confirming that the dispute is submitted in good faith and that the information provided is accurate to the best of the complainant's knowledge.

Complaints that do not conform to the prescribed format will not be acknowledged, reviewed, or acted upon under any circumstance. A complaint submitted outside of this format does not initiate the dispute process, does not place any obligation on ENG3N LLC to respond, and does not preserve any rights the complainant may otherwise have under this agreement. The clock on the 10 business day professional response window does not begin until a fully compliant complaint has been received and confirmed by ENG3N LLC.

​

ENG3N LLC will send a single confirmation email acknowledging receipt of a compliant complaint within 3 business days of submission. If no confirmation is received within that window the complainant should resubmit. Absence of confirmation means the complaint was not received in compliant form and the dispute process has not been initiated.

​

This requirement exists not to create barriers but to ensure that every dispute reviewed by ENG3N LLC is substantive, documented, and submitted in good faith. The prescribed format protects both parties equally. A professional member deserves to know exactly what they are being accused of. An attorney member deserves to know their complaint will be taken seriously. Neither outcome is possible without a complete and properly formatted submission.

​

Upon receipt of a documented dispute ENG3N will notify the professional member in question. The professional member will have 10 business days from the date of notification to respond with evidence supporting their claimed credentials. If the professional member fails to respond within the allotted time or cannot provide satisfactory evidence, their membership will be permanently terminated without refund and the disputing attorney member's unlock credit will be reinstated to their account.

​

Credit reinstatement is the sole remedy available to attorney members in cases of confirmed professional misrepresentation. No cash refund will be issued under any circumstance. Reinstated credits are subject to the same expiration terms as originally issued credits and carry no cash value.

ENG3N's determination in all dispute matters is final. All disputes are reviewed independently and without preference to either party regardless of the size of their account, their tenure on the platform, or any other factor

10. Availability Light System

​

Industry Insiders control their own availability status through a three-state indicator displayed on their listing profile.

Green indicates the Insider is actively available and open to contact from attorney members. Green status is valid for a 24-hour period from the time it is set and will revert to Yellow upon expiration unless manually renewed.

​

Yellow indicates the Insider may currently be engaged in active work or negotiations but may still be available for additional engagement. Attorneys are encouraged to unlock Yellow profiles if the Insider's qualifications match their case needs.

Red indicates the Insider is not available.

​

Industry Insiders are responsible for keeping their availability status current and accurate. If an Insider does not log in to the platform for seven consecutive days, the system will automatically set the availability indicator to Red. Logging back in to the platform does not automatically restore any prior status. The Insider must manually reset their indicator to Green or Yellow. This is intentional. Availability is an active representation, not a default state.

​

Attorney members who unlock contact information for an Insider whose light is Red at the time of unlock do so with full knowledge of that status. ENG3N bears no responsibility for availability representations made by Industry Insiders or for any failure to update availability status in a timely manner. No credit reinstatement will be issued to any attorney member on the basis of an Insider's availability status at the time of unlock regardless of whether that status was current or auto-generated.

11. Conduct and Platform Integrity 

​

Attorney members agree to conduct themselves professionally and in good faith at all times while using the ENG3N platform and in all communications with professional members following an unlock. ENG3N is a closed professional ecosystem built on trust. The integrity of that ecosystem depends on the conduct of every member within it.

​

The following are prohibited and constitute grounds for immediate review and potential permanent removal without refund:

​

Submission of false or misleading information at any stage of the application or membership process.

​

Use of contact information obtained through an unlock for any purpose other than legitimate litigation support, consulting, research, or expert witness engagement. Any attorney member found to have misused contact information obtained through an unlock, including but not limited to unsolicited solicitation, harassment, or use for purposes unrelated to litigation support, is subject to immediate review and permanent removal without refund. No credit reinstatement will be issued to any member removed for misuse of unlocked contact information.

​

Submission of disputes in bad faith or without reasonable supporting documentation for the purpose of obtaining credit reinstatement without legitimate cause.

​

Any attempt to circumvent the platform's access controls, pricing structure, or terms of use.

​

Any conduct that ENG3N LLC determines, in its sole discretion, to be detrimental to the platform, its members, or its reputation.

​

ENG3N does not monitor communications between members following an unlock. However, if credible evidence of prohibited conduct is brought to ENG3N's attention through the dispute process, it will be reviewed with the same independence and fairness applied to all matters on this platform.

​

12. Limitation of Liability

​

ENG3N LLC's liability to any attorney member arising from or related to the use of this platform is limited in all cases to the amount paid by that member for their current membership term. ENG3N LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages of any kind arising from or related to the use of this platform, the conduct of any professional member, the outcome of any case or matter in which a professional member was engaged, or the failure of any professional member to perform as expected or represented.

​

ENG3N is a connection platform. It does not practice law, provide legal advice, supervise professional engagements, or guarantee outcomes of any kind. The attorney member assumes full professional responsibility for all decisions made in connection with any professional engaged through this platform.

​

Nothing in this agreement shall be construed to limit ENG3N LLC's liability for gross negligence, willful misconduct, or fraud.

​

13. Governing Law and Dispute Resolution

​

This agreement is governed by the laws of the State of North Carolina without regard to its conflict of law provisions. Any dispute arising from or related to this agreement or the use of the ENG3N platform shall be resolved through binding arbitration administered by a mutually agreed upon neutral arbitrator in Gaston County, North Carolina. Both parties waive the right to a jury trial and to participation in any class action arising from or related to this agreement or the use of the platform. The arbitrator's decision shall be final and binding on all parties and may be entered as a judgment in any court of competent jurisdiction.

The parties agree that prior to initiating arbitration they will attempt in good faith to resolve any dispute informally by submitting a written description of the dispute to info@eng3nllc.com and allowing ENG3N LLC thirty days to respond and attempt resolution. This informal resolution requirement does not apply in cases where immediate arbitration is necessary to prevent irreparable harm.

14. Intellectual Property

​

All content associated with the ENG3N platform including but not limited to its name, logo, tagline, design, copy, structure, and the E•3™ mark are the exclusive intellectual property of ENG3N LLC. Unauthorized reproduction, imitation, distribution, or use of any ENG3N intellectual property in any form is prohibited and may result in legal action. Membership in ENG3N confers no license or right to use any ENG3N intellectual property for any purpose outside of the platform.

15. Our Commitment to Fairness 

​

ENG3N LLC was built on the belief that the legal process, at its best, is the most effective system of fairness ever devised by human beings. We exist to serve that process. It follows that we hold ourselves to the same standard.

​

Every complaint received by ENG3N will be treated as legitimate until the evidence determines otherwise. Every member accused of a violation will be notified promptly and given a full and fair opportunity to respond. No determination will be made until both sides have been heard completely and without prejudice. No member of this platform, regardless of the size of their firm, the weight of their wallet, or the prestige of their credentials, will receive preferential treatment in any review conducted by ENG3N LLC.

​

We understand that there are three sides to every dispute. The complainant's account. The respondent's account. And the truth. Our obligation is to the truth. Nothing else.

​

A negative verdict, unfavorable ruling, settlement, dismissal, or any other adverse outcome in a legal matter is not, by itself, evidence of professional inadequacy on the part of any expert engaged through this platform. A dissatisfied attorney is not evidence of misconduct. An outcome that did not meet expectations is not grounds for removal. What the evidence demonstrates regarding the conduct and representations of the member is what governs. What the evidence demonstrates is all that governs.

​

ENG3N LLC reserves the sole right to make final determinations in all disputes arising from the use of this platform. Those determinations will be made deliberately, independently, and without outside influence. Once issued, they are final.

​

We are fair. We will always be fair. That is not a promise we make lightly. It is the foundation this platform was built on and the standard we will be held to.

​

16. Amendments to this Agreement

​

ENG3N LLC reserves the right to amend or update this agreement at any time. Members will be notified of material changes via the email address on file. Continued use of the platform following notification of any amendment constitutes acceptance of the revised terms. Members who do not accept amended terms must notify ENG3N LLC at info@eng3nllc.com prior to their next membership renewal. Continued use of the platform after notification of changes and without objection constitutes binding acceptance.

17. Severability

​

If any provision of this agreement is found to be invalid, unlawful, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable. If modification is not possible, the provision shall be severed from this agreement. The remaining provisions of this agreement shall continue in full force and effect.
